Regulation respecting the rate to determine the costs of sampling, analysis, inspection or investigation included in the costs of civil or penal proceedings instituted for the purposes of the Environment Quality Act
Act respecting certain measures enabling the enforcement of environmental and dam safety legislation
(chapter M-11.6, s. 89).
The former alphanumerical designation of this Regulation was chapter Q-2, r. 47.
The rates prescribed in the Regulation have been indexed as of 1 January 2024 pursuant to the notice published in Part 1 (French) of the Gazette officielle du Québec of 23 December 2023, page 871. (s. 3, Sch. I)

1. The costs incurred by the Minister of Sustainable Development, Environment and Parks includes the costs related to the use of the personnel and equipment of the Ministère du Développement durable, de l’Environnement et des Parcs and, if any, the costs related to the use of external human or material resources.

2. The rate for departmental labour and special equipment is established in Schedule I.

3. Despite section 2, the rate for a laboratory analysis made by the Department is established on the basis of the time required for the analysis at an hourly rate of $139.60, including manpower and equipment.

4. The rate for external human and material resources corresponds to the actual costs incurred by the Minister.

5. The costs established in section 3 and in Schedule I to this Regulation are adjusted on 1 January of each year based on the percentage change in the Consumer Price Indexes for Canada, as published by Statistics Canada; the change is calculated by determining the difference between the average of the monthly indexes for the 12-month period ending on 30 September of the preceding year and the average of the monthly indexes for the equivalent period of the second preceding year.
The Minister is to publish the results of the adjustment in the Gazette officielle du Québec before 1 January of each year and, if the Minister considers it appropriate, by any other means.
